Terms of Service
Plain-English summary of our agreement. The full legal terms still govern your use of our services.

1. Who We Are
Automate the Journey, Inc. ("ATJ," "we," "us") provides done-for-you marketing automation and AI teammates for independent service businesses. When you sign up for any ATJ plan or use our platform, these Terms govern the relationship between you ("Client," "you") and ATJ.
2. Using Our Services
Eligibility
Our services are designed for businesses, not individual consumers. By signing up you represent that you are acting on behalf of a business entity and have authority to bind that entity to these Terms.
Acceptable Use
You agree not to use our services to:
- Send unsolicited bulk messages (spam) or violate CAN-SPAM, TCPA, or equivalent laws
- Transmit malware, phishing content, or any material that infringes third-party rights
- Interfere with, disrupt, or overload ATJ infrastructure
Your Content
You retain ownership of all content you provide. You are solely responsible for ensuring your content complies with applicable laws and does not infringe any third-party rights.
Third-Party Tools
Our services integrate with third-party platforms (GoHighLevel, Google, Meta, etc.). Your use of those platforms is subject to their own terms and policies. ATJ is not liable for changes or outages on third-party platforms.
3. Fees & Billing
Flat-Rate Plans
ATJ offers flat-rate monthly plans. Pricing is quoted before you subscribe and confirmed in your service agreement or checkout page.
Usage Caps
Certain plans include usage caps (e.g., number of workflows, contacts, or AI actions per month). Overages beyond your plan cap may be billed at the rates specified in your agreement or paused until the next billing cycle.
Invoices & Payment
Invoices are issued at the start of each billing period. Payment is due upon receipt. We accept major credit cards and ACH. Late payments may incur a 1.5% monthly finance charge.
Refunds
Because our services involve custom setup work, fees are generally non-refundable once a billing period has started. If you believe a charge is incorrect, contact us within 30 days and we will work to resolve it promptly.
4. Term & Cancellation
Month-to-Month
Unless your agreement states otherwise, all plans are month-to-month. Either party may cancel with 30 days' written notice before the next billing date.
Data Exports
Upon cancellation you may request an export of your data. We will provide a reasonable export within 30 days. After 60 days post-cancellation, we may delete your data from active systems.
Suspension
We may suspend your account immediately if you violate the Acceptable Use policy, fail to pay invoices after two reminders, or if required by law. We will notify you and, where possible, give you an opportunity to cure.
5. Confidentiality & Intellectual Property
Confidentiality
Each party agrees to keep confidential information received from the other party private and to use it only for the purposes of this agreement. Standard exceptions apply (public knowledge, independent development, legal compulsion).
Your IP
You own your brand assets, customer data, and content. You grant ATJ a limited license to use these materials solely to deliver the services.
Our IP
ATJ retains ownership of its proprietary tools, templates, workflows, and methodologies. You receive a non-exclusive license to use deliverables created for you during the term of your engagement.
6. Warranties & Disclaimers
As-Is
Our services are provided "as is" and "as available." We do not guarantee specific results, conversion rates, or revenue outcomes. Marketing results depend on many factors outside our control.
Availability
We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and force majeure events may affect availability.
7. Limitation of Liability
Liability Cap
To the maximum extent permitted by law, ATJ's total liability under these Terms is limited to the fees you paid in the three (3) months immediately preceding the claim.
No Indirect Damages
Neither party will be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, regardless of the theory of liability.
8. Compliance & Data Protection
When ATJ processes personal data on your behalf, you act as the data controller and ATJ acts as the data processor. We process data only as instructed by you and in accordance with our Privacy Policy.

9. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice at least 30 days before they take effect. Continued use of the services after the effective date constitutes acceptance of the updated Terms.
